These Terms & Conditions (“Terms”) govern the Kuarbaa website, product information, quotation service, online store and related support services operated by Kuarbaa Group (“Kuarbaa”, “we”, “us” or “our”), a trading name with its place of business in China. They apply to both (1) individual consumers buying for personal use (B2C) and (2) businesses or other organisations buying for commercial use (B2B). By using the website, submitting an enquiry, creating an account or placing an order, you agree to the Terms that apply to your transaction.

Our Privacy Policy explains personal-information handling, and our Cookie Policy explains cookie choices. If a written quotation, order confirmation or sales agreement conflicts with these Terms, the transaction document controls for that transaction.

1. Website and product information

We aim to keep descriptions, specifications, images, prices and availability accurate. Product information is general guidance and may change because of product updates, regional requirements, packaging or manufacturing changes. The final quotation, technical drawing, order confirmation and agreed configuration control a specific transaction.

2. Quotations and order acceptance

A quotation is an invitation to discuss a transaction and is valid for the period stated in it. It may depend on configuration, quantity, destination, shipping method, taxes, duties, customs requirements and payment terms. An online order or enquiry is not accepted until Kuarbaa confirms it in writing, issues an order confirmation or begins fulfilment. We may decline or cancel an order where a product is unavailable, information is materially incorrect, payment is not authorised, or an export, sanctions, safety or other compliance restriction applies.

3. Prices, payment and PayPal

Unless stated otherwise, displayed prices are in the shown currency and exclude shipping, insurance, customs duties, import charges and applicable taxes. The final total may be confirmed at checkout, in a quotation or in an order confirmation. Large equipment, custom configurations and quantity purchases may be sold only by quotation.

Payment methods may include PayPal or other methods shown at checkout or in the quotation. Payment must be authorised before dispatch or production unless the written transaction terms state otherwise. Payment providers may apply their own verification, refund, dispute and privacy rules. You must provide accurate billing, shipping and business information and have authority to use the selected payment method.

4. Shipping, delivery, risk and title

Delivery dates are estimates unless a written order confirmation expressly guarantees a date. The buyer must provide accurate delivery information and, unless the order document states otherwise, is responsible for import licences, customs clearance, duties, taxes and destination charges.

For B2C orders, risk generally passes when the goods are delivered to you or a person you designate, except where mandatory consumer law provides otherwise. For B2B orders, risk and title pass as stated in the order confirmation or agreed Incoterms; if the transaction document is silent, the applicable delivery and payment terms will determine the point of transfer. We may retain title to goods until payment is received in full where permitted by applicable law.

5. B2C consumer rights

This section applies only to an individual consumer buying for personal use. It does not remove or reduce mandatory consumer rights in your country.

Where EU, EEA, UK or similar consumer law applies, you may have a 14-day cooling-off or withdrawal period for distance purchases, starting when you or your designated person receives the goods. To exercise it, contact support@kuarbaa.com with your order details and a clear statement before the period expires. You must take reasonable care of the goods and return them within the period required by applicable law. Unless the goods are faulty, incorrect or the law requires otherwise, you normally pay the direct return shipping cost. We will refund eligible payments using the original payment method, subject to lawful deductions and the applicable timing rules.

The cooling-off right may not apply to goods made to your specifications, personalised or clearly customised goods, sealed goods unsuitable for return for health or hygiene reasons after opening, goods that become inseparably mixed after delivery, or other statutory exceptions. Nothing here affects statutory remedies for goods that are faulty, unsafe, not as described or not fit for purpose.

The European Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025. It is therefore not possible to provide an active ODR submission link. EU consumers may consult the European Consumer Redress portal and the dispute-resolution bodies in their country at consumer-redress.ec.europa.eu, or use any local alternative-dispute-resolution route available under applicable law.

6. B2B commercial customer terms

This section applies only to a business, company, reseller, contractor or other organisation buying for commercial or professional purposes. B2B customers do not receive the B2C 14-day cooling-off right unless the written agreement or mandatory law expressly provides it. The quotation, purchase order, order confirmation and agreed technical documents may set different payment, delivery, warranty, inspection, acceptance, return and claim terms for the business transaction.

B2B customers must inspect goods promptly, notify us of visible damage or shortage within the period stated in the order document, and provide reasonable evidence for a claim. Subject to mandatory law and the transaction document, a B2B customer’s remedies may be limited to repair, replacement, credit or refund of the affected goods. A B2B customer is responsible for confirming that the product, configuration and intended use meet its requirements.

7. Warranty and service

Warranty coverage, duration, exclusions and service procedures are stated in the applicable product warranty, quotation or order confirmation. For B2C consumers, statutory conformity and consumer remedies remain in addition to any commercial warranty. For B2B customers, the written warranty and agreed service terms control, subject to mandatory law.

Warranty exclusions may include misuse, incorrect installation, unauthorised modification, unsuitable power or environment, normal wear, consumables, accident, failure to follow instructions, third-party repairs or damage caused after delivery. Contact support@kuarbaa.com promptly with the order number, serial number, photographs and a description of the issue.

8. Cancellation, breach and claims

A cancellation request must be sent promptly to sales@kuarbaa.com. Cancellation, restocking, production and return consequences depend on the order status, product type and applicable B2C or B2B rules. We may suspend or cancel an order for non-payment, inaccurate information, misuse, fraud, export-control concerns or material breach. You remain responsible for amounts properly due and for reasonable losses caused by a breach, subject to applicable law.

9. Liability

For B2C consumers, nothing in these Terms excludes or limits liability, statutory guarantees, refund rights or other protections that cannot lawfully be excluded or limited. We do not exclude liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that law does not permit us to exclude.

For B2B customers only, to the extent permitted by law and unless the written transaction document states otherwise, Kuarbaa will not be liable for indirect or consequential loss, loss of profit, revenue, business, goodwill or data, and our aggregate liability for the affected transaction will not exceed the amount paid or payable for that transaction. This limitation does not apply to liability that cannot lawfully be limited.

10. Acceptable use and intellectual property

You must not misuse the website, interfere with security, introduce malicious code, attempt unauthorised access, submit false information, infringe another person’s rights or use the website in breach of law, sanctions or export controls. Website text, product images, logos, downloads and other content are owned by or licensed to Kuarbaa. You may use them to evaluate or purchase our products, but may not copy, modify, redistribute or commercially exploit them without written permission.

11. Force majeure and compliance

We are not responsible for delay or failure caused by events beyond reasonable control, including natural disasters, epidemics, war, civil unrest, labour disputes, transport disruption, shortages, cyber incidents, government action, sanctions, export controls or customs restrictions. Each party must comply with applicable anti-bribery, sanctions, export-control, import, product-safety and consumer-protection laws.

12. Governing law and disputes

The governing law, dispute-resolution method and competent courts for a specific transaction should be stated in the applicable quotation, order confirmation or written sales agreement. If those documents do not state otherwise, the parties will first try in good faith to resolve a dispute through written communication with Kuarbaa. Mandatory consumer protections and other rights that cannot lawfully be waived remain unaffected.

13. Contact and updates

For sales enquiries, quotations or order-business questions, contact sales@kuarbaa.com. For after-sales, technical, warranty, repair or return questions, contact support@kuarbaa.com. For privacy or Cookie questions, contact info@kuarbaa.com. We may update these Terms when the website, products, services or legal requirements change. The current version is the one published on this page.
